Lexus of Tucson (“Lexus of Tucson”, “we”, “us”, or “our”) appreciates your interest in our products and services and your visit to our website, lexusoftucson.com (including lexusoftucsonautomall.com and lexusoftucsonspeedway.com) (“Sites”).  Your privacy is important to us, and we are committed to protecting it.  This privacy policy (“Privacy Policy”) explains what information may be collected through the Sites, how such information may be used and/or shared with others, how we safeguard it, and how you may access and control its use in connection with our marketing communications and activities.

Please read this Privacy Policy carefully because by using the Sites, you are acknowledging that you understand and agree to the terms of this Privacy Policy.

WE COLLECT THE FOLLOWING TYPES OF INFORMATION

Information You Provide to Us

You can visit the Sites to read and learn about our products and services, without telling us who you are and without revealing any personal information.  Personal information is information that identifies an individual or is directly associated with a specific person, such as a customer’s name, mailing address, telephone number, email address, credit card information, Social Security number, income, credit history, employment information, or information about activities which can be directly linked to that person, such as that person’s purchases, account balances, and payment history (“Personal Information”).

However, to use certain features or to participate in any special programs, you may need to provide Personal Information.  The types of Personal Information we collect depend on the product and service provided to you.  For example, we collect your Personal Information when you apply for financing or provide us information regarding your income, employment, and account(s).

Information We Collect Automatically

When you visit or interact with the Sites, we may collect and store information about your visit on an anonymous, aggregate basis.  This information may include the time and length of your visit, the pages you look at on the Sites, clicks, and the websites you visited just before coming to us (collectively, “Usage Information”).  We use this information only to measure site activity, develop ideas for improving the Sites, and tailor content to a visitor’s interests.

We may also collect your IP address or other unique identifier (“Device Identifier”) for the computer, mobile device, technology or other device (collectively, “Device”) you use to access the Sites.  A Device Identifier is a number that is automatically assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier.

The tracking technologies used on the Sites to collect Usage Information and Device Identifiers may include, without limitation:

Cookies:  The Sites may use “cookie” technology to measure site activity and to customize information to your personal tastes. Cookies are data files placed on a Device when it is used to visit the Sites.  We may place cookies or similar files on your Device for security purposes, to customize our communications with you, to facilitate site navigation, and to personalize your experience while visiting the Sites.  The goal is to save you time and provide you with a more meaningful visit.  If you would prefer not to accept cookies, you can change your browser settings to notify you when you receive a cookie, which allows you to choose whether or not to accept it, or you can set your browser to automatically not accept any cookies.  However, please be aware that some features and services on the Sites may not work properly because we may not be able to recognize and associate you with your account(s).

Pixel tags:  We may use “pixel tags” on the Sites and may permit third parties to place them on the Sites to monitor the effectiveness of different types of advertising.  A pixel tag is a transparent graphic image, sometimes called a web beacon, clear GIF, or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed. 

Information We Receive From Third Parties

We may receive information about you from third parties, such as consumer reporting agencies, credit references, employers, insurance companies, and insurance agencies. You may also choose to participate in a third-party application or feature through which you allow us to collect (or the third party to share) information about you, including Personal Information (as defined above).  In addition, we may receive information about you if other users of a third-party website give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your connections’ web page, profile page, or similar page on a social networking or other third-party website or interactive service.

We may also supplement the information we collect about you through the Sites with outside records from third parties in order to enhance our ability to serve you, to tailor our content to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you.  We may combine the information we receive from these third parties with information we collect through the Sites.  In those cases, we will apply this Privacy Policy to any Personal Information received, unless we have disclosed otherwise.

HOW WE USE THE INFORMATION WE COLLECT

We use the information we collect about and from you for a variety of business purposes, including for example, to:

  • respond to your questions and requests such as requests for product information, new vehicle information alerts, and brochures;
  • advise you of important safety-related information;
  • enable you to participate in promotional activities or other programs;
  • provide you with access to certain services, areas, and features of the Sites;
  • verify your identity;
  • communicate with you about your account and activities on the Sites and, in our discretion, changes to any of our policies;
  • tailor content, advertisements, and offers we send to you;
  • improve the Sites;
  • process applications and transactions;
  • for internal business purposes; and
  • for purposes disclosed at the time you disclose your Personal Information or otherwise with your consent. 

 

SHARING OR DISCLOSURE OF INFORMATION

Except as provided in this Privacy Policy, we will not share, sell, or rent any of your Personal Information to any third parties without your specific consent.  We may share non-Personal Information, such as aggregate user statistics, demographic information, and Usage Information, with third parties without your specific consent.  When you are no longer our customer, we may continue to share your information as described in this Privacy Policy.  We may also share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy, and in the following circumstances:

Third Parties Providing Services on Our Behalf:  In order to carry out your requests, to make various features, services, and materials available to you through the Sites, and to respond to your inquiries, we may share your Personal Information or Usage Information with third parties that perform functions on our behalf (or on behalf of our partners), such as companies or individuals that host or operate the Sites, analyze data, provide customer service, or perform marketing services for us or other third parties with which we have joint marketing agreements.  These third parties are required to keep the information confidential and are not permitted to use the information for any other purpose than to carry out the services they are performing for us.

Your Agreement to Have Your Personal Information Shared:  While on the Sites, you may have the opportunity to opt-in to receive information and/or marketing offers from a third party or to otherwise consent to the sharing of your Personal Information with a third party.  If you agree to have your Personal Information shared, your Personal Information will be disclosed to the third party and the Personal Information you disclose will be subject to the privacy policy and business practices of that third party.

Business Transfers:  Your Personal Information may also be used by us or shared with our business partners, affiliates and other entities in the family of companies controlled by or under common control with Lexus of Tucson for internal reasons, primarily for business and operational purposes.  As we continue to develop our business, we may sell or purchase assets.  If another entity acquires us or all or substantially all of our assets, or assets related to the Sites, Personal Information, Usage Information, and any other information that we have collected about the users of the Sites may be disclosed to such entity as part of the due diligence process and will be transferred to such entity as one of the transferred assets.  Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Nonaffiliated Third Parties:  We may disclose your Private Information, Usage Information, and Device Identifiers to nonaffiliated third parties, such as Lexus Corporate, a division of Toyota Motor Sales, U.S.A, Inc., as permitted by law.  Lexus Corporate may use such information to track visitors’ website visits, activities, and other related data for marketing purposes.

Legal Disclosure:  We may transfer and disclose information, including  your Personal Information, Usage Information, and Device Identifiers (including your IP address), to third parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of the Sites, Lexus of Tucson, third parties, visitors to the Sites, or the public, as determined by us in our sole discretion.

YOUR CHOICES AND DELETION OF INFORMATION

The Sites give you choices.  If you choose to receive emails from us about products, services, and other information, we strive to keep your Personal Information updated and accurate.

In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Sites.  We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information.  In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.

Protection of YOUR Information

We use commercially reasonable security measures to help protect your Personal Information against loss, theft, destruction, unauthorized access, disclosure, and modification.  This includes using “Secure Socket Layers” or SSL to protect your information as it is sent over the Internet to our server, as well as storing your information on our servers behind a secure firewall and ensuring all transmissions to third parties use secure encryption technology.  However, no electronic data transmission or storage of information can be guaranteed to be 100% secure.  Because we cannot ensure or warrant the security of any information you transmit to us, you use the Sites and provide us with information at your own risk.

We restrict access to your Private Information to our employees who need to know such information to provide products or services to you and to perform their job duties, and to other persons necessary to assist us in providing you with products or services.

ACCURACY OF INFORMATION

We will use reasonable efforts to ensure that the contents of the Sites are accurate and up-to-date. However, we make no warranties, representations or guarantees as to the Sites’ accuracy. We will not be responsible for any direct, incidental, indirect, consequential, or punitive damage or loss which may occur as a result of your use of the Sites.  We will not be responsible for typographical or other errors or omissions regarding prices or other information on the Sites.

CONSENT TO PROCESSING

By visiting the Sites and by providing your information to us, you understand and consent to the collection, use, processing, transfer, and disclosure of your information in the state of Arizona in accordance with this Privacy Policy. 

The information contained on the Sites is intended for consumers within the state of Arizona and may not be applicable to other jurisdictions.  If you access the Sites from other states or outside the United States, you are responsible for compliance with any and all applicable local laws.

CHILDREN’S PRIVACY

We do not knowingly intend to collect Personal Information from children under 13 years of age.  If we learn that a visitor is under 13 and has submitted Personal Information to us, we will delete that information as promptly as possible.

LINKS TO OTHER WEBSITES

The Sites may contain links to other websites not controlled by us or covered by this Privacy Policy. We recommend that you check the privacy statements of other websites you visit before providing any Personal Information.  We are not responsible for the privacy statements, content, or data handling practices on other websites.

Lexus of Tucson and Lexus Corporate, a division of Toyota Motor Sales, U.S.A, Inc., are nonaffiliated third parties and this Privacy Policy applies only to the Sites and not the Lexus Corporate website (lexus.com).

All other materials within the Sites are the intellectual property of Cobalt Group or Royalex Limited Liability Company.  Such materials may not be copied or reproduced, except to the extent necessary to view online.  However, you may print complete pages of the Sites to hard copy for your own personal use, provided you do not delete or change any copyright, trademark, or other proprietary notices.  Modification or use of the material on the Sites for any other purpose may violate the law.

Email Correspondence and Email Marketing

From time to time we may send you relevant information pertaining to sales, service, financial, or parts specials.  You would receive this correspondence if you have at one time either done business with us or expressed interest in doing business with us.  We respect your email privacy and never sell or purchase email addresses.  If at any time you would like to no longer receive email messages, there are two methods of opting out:

  • Send an email to marketing@royaltucson.com with your email address in the subject line and brief instructions in the body of the email expressing your desire to “Opt out of future marketing”; or

 

  • Call (520) 696-2800 or (520) 745-3987 and request that you be opted out of marketing efforts. Please ensure you leave your current email address so that we may purge your record from our system.
